French National Asylum Court: Afghan Women Can Obtain Asylum in France

July 16, 2024

Zan News

Zan News: The French National Asylum Court (CNDA) has announced in a ruling that all Afghan women protesters who are victims of the Taliban's strict policies and are fighting against them can obtain asylum in France.

According to Radio France National, the CNDA issued this ruling on Thursday (July 11). According to the court's decision, Afghan women protesters are considered a "social group" and should be protected as refugees.

The CNDA stated that the Taliban, after retaking control of Afghanistan, have deprived women of their basic rights, including the right to education.

The court also cited the Geneva Convention, classifying the Taliban's "discriminatory" actions against women in Afghanistan as "persecution."

In France, the right to asylum is determined by the Convention Relating to the Status of Refugees. Under Article 1 of this international convention, adopted in Geneva in 1951 after World War II, a "refugee" is defined as someone who is persecuted due to race, religion, nationality, membership in a particular social group, or political opinion.

The CNDA ruling requires approval from the country's high court to be implemented.

It is worth noting that over the past five years, approximately 17,103 Afghan citizens have applied for asylum in France.
